Terms of use

The terms on which we provide the assessment and the report. Short, because the service is small and the obligations should be legible.

This document must be reviewed by a South African privacy lawyer before it is relied on with real customers. It was drafted to be accurate about what the product actually does and to be POPIA-aware, but it is not legal advice and it carries no professional assurance. If you are evaluating this service for an organisation with meaningful obligations, treat this document as a statement of intent rather than as a warranty.

1. Who you are contracting with

These terms are an agreement between you and the business named below. “We”, “us” and “our” mean that business throughout.

aireadiness is operated by Boondock Labs, a business conducted by Eugene Boondock (full legal name Eugene Loyiso Mzimakhwe) in South Africa.

Still outstanding before this document is complete: a registration number, a business address, registration of the Information Officer with the Information Regulator. These are stated as missing rather than left out.

2. What this service is

aireadiness provides a structured self-assessment of a business’s readiness to undertake an AI project, an optional written report based on that assessment, and an optional agent scan that examines material you supply.

The assessment produces a score from a fixed rubric applied to the answers you give. It is a self-assessment: it records what you tell us and is not verified against your systems, your records or anyone else’s account of them.

3. What this service is not

  • It is not a compliance determination. Nothing in your result establishes whether you comply with POPIA or any other law. Where the result raises privacy or governance concerns, those are possible gaps requiring verification, not findings.
  • It is not legal advice. We are not attorneys and nothing here creates an attorney-client relationship.
  • It is not financial or investment advice. A recommendation to run a pilot is not advice on how to spend money.
  • It is not an audit. No audit standard has been applied and no assurance is expressed.
  • It is not a guarantee of any outcome. A high score does not mean an AI project will succeed. A low score does not mean it will fail.

4. Using the service

You agree that you will:

  • Provide answers that are accurate to the best of your knowledge. A result built on inaccurate answers is worthless, and the person it is worthless to is you.
  • Not paste personal information about other people into the conversation. The questions do not require it.
  • Not attempt to disrupt the service, extract other users’ data, or use automated means to submit assessments at volume.
  • Have authority to describe the systems and practices you are describing, if you are answering on behalf of an organisation.

We may suspend access where use appears intended to disrupt the service or to obtain data belonging to someone else.

5. The free assessment

The assessment, your score, the per-area breakdown, your strengths and blockers, and the recommended next step are provided free of charge. An email address is required to display the full result.

Being free, it is provided as-is. We do not undertake that it will always be available, and we may change the rubric. If we do, results already produced remain readable as scored under the rubric version that produced them.

6. The paid report

The Readiness report costs R10 000 once-off, including VAT. It is not a subscription and nothing recurs.

What you receive:

  • Everything in the free readiness check
  • A written report prepared for your business by name, with a cover, the scorecard, per-area detail and the recommended pilot
  • Per-area detail explaining exactly what each score is based on
  • The recommended pilot written up with prerequisites and effort
  • Upload your own material, policies, process notes, system lists, checked line by line against your answers
  • A revised score showing exactly where those documents and your answers disagree
  • A 45-minute consultation to work through the findings

Payment is handled by PayFast. Your entitlement is granted when PayFast confirms the payment to us, not when your browser returns to our site. In the ordinary case these happen seconds apart.

7. The agent scan

The Agent scan costs R24 500 once-off, including VAT. It is a separate product from the report and is not included in it.

What you receive:

  • Everything in the readiness report
  • A read-only data room where you put your exports, records and system files
  • An agent that works through them itself over dozens of steps: listing, searching, reading, and profiling your actual tables
  • Measured findings rather than impressions: how many rows are missing a field, how many identifiers repeat, how many date formats are in use
  • Every finding quoted from the file it came from, with the quote checked against that file before you are shown it
  • The full audit trail of which files were opened and which commands produced each number
  • A revised score, with every finding yours to accept or reject

What the agent may do. The agent reads the material you place in the data room and runs analysis commands over it. It operates on a read-only copy: it cannot alter, delete or add to your files, and the environment its commands run in has no network access, so your material cannot be sent anywhere from it. It does not connect to your systems and we never ask for a password to any of them. You decide what goes into the data room.

What you are responsible for. You confirm that you are entitled to supply the material you upload and to have it examined. The assessment needs the shape of your data, not its contents, so please do not upload live records about identifiable people. Where you do, the operator agreement governs how we handle it.

What it does not promise. The scan reports what it found in what you gave it. It is not an audit, it does not certify anything, and it cannot find a problem in material it was not given. Findings are proposals: each one is shown with the text it came from and only changes your score if you accept it. A scan that returns few findings is a possible outcome and is not a failure of the service.

Fixing what it finds is not included. The scan reports; it does not repair. Remediation is a separate service that does not currently exist and is not sold here.

Each purchase entitles you to run the scan on one assessment, with a limit on repeat runs per day, because each run carries a real compute cost.

8. Refunds

If the report or the agent scan is not delivered, or is materially not what is described above, email hello@aireadiness.co.za within 14 days and we will refund you in full.

We will not refund on the basis that you disagree with your score, or because the agent scan found less than you hoped in the material you supplied. The rubric is published, the reasoning behind each area score is shown, and the assessment is deliberately capable of telling you that you are not ready. That is the product working, not failing.

Refunds are processed manually through PayFast and typically take 5 to 10 working days to reach your account. When a refund is issued, access to the refunded product is withdrawn.

Nothing here limits any right you have under the Consumer Protection Act 68 of 2008.

9. Availability

We do not offer a service level guarantee. The service depends on third parties (Cloudflare, OpenAI, PayFast) and can be interrupted by their outages as well as our own. We will not charge you for a report we cannot deliver.

10. Your content and our content

Your answers remain yours. You grant us only the permission needed to run the assessment, produce your result and report, and provide support, as described in the privacy notice.

The rubric, the site and the report format remain ours. Your report is yours to use inside your organisation, to circulate to your advisers and to your board. Do not republish the rubric itself as your own.

11. Liability

To the extent permitted by law, our total liability arising out of this service is limited to the amount you paid us in the 12 months before the claim. For a free assessment, that amount is zero.

We are not liable for decisions you take on the basis of your result. The assessment is an input to your judgement, not a substitute for it.

Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

12. Changes and governing law

We may change these terms. The date at the top will change with them, and continued use after a change means you accept it. Where a change materially affects a report you have paid for but not yet received, the terms at the time of purchase apply.

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
